The online store www.janubottle.com (hereinafter referred to as the Online Store) is owned by Janu Bottle OÜ (registry code 17447389), located at Ristiku 19, 79852, Kohila, Estonia.

Validity of the Sales Contract, Product and Price Information

These terms of sale apply when purchasing products from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. A delivery fee is added to the price.

The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer when placing the order. For international orders, please contact the Online Store at info@janubottle.com to determine the delivery cost.

Information about the products is provided directly next to the products in the Online Store.

Placing an Order

To order products, the desired products must be added to the shopping cart. To place an order, the required fields must be filled in and a suitable delivery method must be selected. The total amount payable will then be displayed on the screen and can be paid via a bank link or another payment solution.

The contract enters into force once the amount payable has been received in the Online Store’s bank account.

If the ordered product cannot be delivered due to being out of stock or for any other reason, the buyer will be informed as soon as possible and the amount paid, including delivery costs, will be refunded without delay, but no later than within 14 days of sending the notification.

Delivery

Products are shipped within Europe.

Delivery costs are borne by the buyer, and the relevant price information is displayed next to the delivery method. Products are delivered both to parcel lockers and by courier. The Online Store’s delivery partners are SmartPosti OÜ and AS Eesti Post.

Shipments within Estonia generally arrive at the destination specified by the buyer within 3–7 business days from the entry into force of the sales contract. For delivery times within Europe, please contact the Online Store at info@janubottle.com, as delivery times vary depending on the destination country.

In exceptional cases, the Online Store has the right to deliver the goods within up to 45 calendar days.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered product must not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the product, in the same manner as would be allowed when testing the product in a physical store.

If the product has been used for any purpose other than what is necessary to verify its nature, characteristics, and functioning, or if it shows signs of use or wear, the Online Store has the right to reduce the refund amount according to the decrease in the product’s value.

To return the product, a simple withdrawal statement must be submitted and sent to info@janubottle.com no later than 14 days after receiving the product.

The cost of returning the product is borne by the buyer, except in cases where the reason for the return is that the item does not correspond to the order, for example if the item is incorrect or defective.

The buyer must return the product within 14 days of submitting the withdrawal statement or provide proof that the product has been handed over to the carrier within the aforementioned period.

Upon receiving the returned product, the Online Store will refund the buyer without delay, but no later than within 14 days from receiving the withdrawal statement, all payments received from the buyer under the contract.

The Online Store may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided proof that the item has been returned, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to reimburse the buyer for the cost exceeding the cost of the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the product from the buyer if the product price in the Online Store has been mistakenly marked significantly below the market price of the product.

Right to Submit a Complaint

In the event of a defect, the buyer has the right to contact the Online Store within two months at the latest by sending an email to info@janubottle.com or by calling +372 54 50 1103.

The Online Store is not liable for defects that have occurred after the product has been handed over to the buyer.

If a product purchased from the Online Store has defects for which the Online Store is responsible, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.

The Online Store will respond to a consumer complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer, including name, telephone number, address, email address, and bank details, only for processing the order and delivering the goods to the buyer. The Online Store forwards personal data to companies providing delivery services for the purpose of delivering the goods.

The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive them by entering their email address on the website and indicating their wish to receive direct marketing notifications.

The buyer can unsubscribe from offers and newsletters sent by email at any time by notifying us by email or by following the instructions provided in the email containing the offers.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they must be sent by email to info@janubottle.com.

If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.

The buyer may also turn to the European Union’s online dispute resolution platform.
